List Building Ideas Contest
Sponsored by DEMC
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Contest
begins at 12:01 am Eastern Time (ET) on 10/16/03 and ends at 11:59 PM ET on 10/31/03 ("Contest Period").
2. ELIGIBILITY: Void where prohibited. Contest is offered only to individuals 18 years of age or older with
Internet access prior to 10/15/03. Employees (and the immediate families and members of the same household of such employees) of DEMC ("Sponsor"), its respective divisions, affiliates, dealers, subsidiaries, advertising
and promotion agencies are not eligible to enter. By participating, entrants agree to abide by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. In the event of a dispute as to the
identity of an entrant, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Potential winners may be required to show proof of being the authorized account holder for
that e-mail address. "Authorized account holder" is defined as the natural person assigned to an e-mail address by an Internet service provider, online service provider, or other organization responsible for assigning
e-mail addresses for the domain.
3. HOW TO ENTER: To enter, complete the online contest entry form at www.demc.com
(the "Website") and submit as directed prior to 11:59 pm ET on 10/31/03. Multiple entries are allowed by the same person and email address. Entries that are incomplete, illegible, corrupted or submitted by facsimile are void and will not be accepted for entry. All entry ideas become the property of Sponsor. Credit will be given to each contestant whose ideas are used.
4. PRIZES / APPROXIMATE RETAIL VALUE (ARV): Four (4) Prizes will be awarded. The first place prize DEMC is giving away is a Solo Ad emailing to 25,000 DEMC subscribers. Your 60 lines of text will be emailed out alone one time to 25,000 DEMC subscribers.(ARV $247) Prize is to be used by winner within
twelve (12) weeks from the time the prize is awarded. Prize is subject to editorial approval of DEMC. Odds of winning depend on the number of eligible entries received and designated for the drawing.The second place
prize DEMC is giving away is a top sponsor "In The Spotlight" advertisement, up to 5 lines of copy (65 characters to a line), sent out in one issue of DEMC E-Magazine (ARV $227) to be used by winner within twelve (12) weeks
from the time the prize is awarded. Prize is subject to editorial approval of DEMC. Odds of winning depend on the number of eligible entries received and designated for the drawing. The third place prize DEMC is giving
away is three "marketplace classified" advertisements. Ads can be up to 5 lines of copy (65 characters to a line). Each ad will be sent out in one issue of DEMC E-Magazine (ARV $180). The classified ad placements must be used by
winner within twelve (12) weeks from the time the prize is awarded. Prize is subject to editorial approval of DEMC. Odds of winning depend on the number of eligible entries received and designated for the drawing The
fourth place prize DEMC is giving away is one "marketplace classified" advertisement. The ad can be up to 5 lines of copy (65 characters to a line). The ad will be sent out in one issue of DEMC E-Magazine (ARV $60). The classified
ad placement must be used by winner within twelve (12) weeks from the time the prize is awarded. Prize is subject to editorial approval of DEMC. Odds of winning depend on the number of eligible entries received and designated for
the drawing.
5. WINNER SELECTION: First, second and third place prize winners will be judged based upon the idea submitted by the contestent. The judges of the contest are the editor of DEMC and the DEMC Featured Writer,
Jean Bim. The judges will decide which idea submitted is the first place winner, the second place winner and the third place winner. The fourth prize winner will be selected from a random drawing conducted on or about
11/03/03 from among all entries received. Each winner will be notified by e-mail within ten (10) days of the drawing date - 11/03/03. If a winner cannot be contacted within fourteen (14) days of the first attempt, or if the
winner fails to comply with these Official Rules, that winner forfeits his/her prize. To claim a prize, each winner must provide DEMC within ten (10) days of notification, his/her full legal name, postal address, and phone number
or that winner will be deemed to have forfeited the prize. Acceptance of a prize constitutes permission for Sponsor to use the winners idea as well as name and likeness for advertising and promotional purposes without
additional compensation, unless prohibited by law. If a winner is not of age of majority in state of residence (a "minor"), prize will be awarded in name of parent or legal guardian. Prizes are not transferable or
exchangeable for cash; however Sponsor reserves the right to substitute a prize of comparable or greater value due to unavailability. If a prize is refused or a prize notification is returned or deemed undeliverable, that
winner forfeits his/her prize. Winner is responsible for all taxes (federal, state and/or local) and any other expenses not listed related to acceptance and use of prize.
6. CONDITIONS: Sponsor is not responsible for error,
omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone, computer, hardware or software
malfunctions of any kind, or inaccurate transmission of, or failure of Sponsor to receive entry information on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof.
Sponsor is also not responsible for any injury or damage to entrant's or any other's computer related to or resulting from playing or downloading any materials in the sweepstakes, regardless of whether the material was prepared by
Sponsor or a third party, and regardless of whether the material is connected to Sponsor's Web site or a participating Web Site by a hypertext link. Sponsor reserves the right, in its sole discretion, to cancel the contest in its
entirety if it becomes technically corrupted or because of non-authorized human intervention. In that event, Sponsor will select winners from all eligible entries received prior to exercising its rights to suspend or cancel the
contest and will post notification of cancellation on www.demc.com. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND
CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. By entering, participants (a) agree to these official rules and
the decisions of the Sponsor and judges which shall be final in all respects; (b) release DEMC their respective divisions, dealers, subsidiaries, affiliates, and advertising and promotion agencies, their respective directors,
officers and employees from any and all liability for any injuries, losses or damages of any kind caused by their participation or resulting from acceptance, possession, use, or misuse of the prize; and (c) acknowledge that said
parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize. Entrant further agrees that: (1) any and all
disputes, claims, and causes of action arising out of or connected with this contest, or any prizes awarded, other than the administration of the contest or the determination of winners shall be resolved individually, without
resort to any form of class action, and exclusively by the United States District Court for the District of Connecticut or the appropriate Connecticut State Court located in New Haven County; (2) any and all claims, judgments and
awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this contest but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for
and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise
increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. All issues and questions concerning the
construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the
laws of the State of Connecticut, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Connecticut, or any other jurisdiction), which would cause the application of the laws of
any jurisdiction other than the State of Connecticut. All federal, state, provincial and local laws apply. Noncompliance with the official rules will result in disqualification.
