Response in favor of T3 Direct in the case of "T3 vs. Joseph McNichol". |

Naturally, I side with T3. Not because I'm an e-mail marketer, but because I enjoy certain freedoms and choices. The certain segment of
society that would have all e-mail they deem to be "spam" prohibited, would control the choices and destinies of us all. I prefer to make my own choices, thank you very much. I happen to make my choices
regarding spam with filters in my e-mail client and my "delete key."
What other controls would they have the government put in place over our lives? Will they also have the postal service decide what
mail they deliver to us? Would they have the government censor more than they already do? Would they have cameras installed in the most private of places to make sure our activities do not insult them? Would they
ultimately control our thoughts?
I do not live in a society that I wish to have make my decisions for me. I'm pretty tired of having someone else try to tell me what's good for me. I truly hope T3 wins their case
and sends a message to those "Holier than thou" who desire to rule the world and shove their opinions and ideas down our throats.
Do these people really want to be responsible for all our lives? They
must see themselves as being the only humans capable of thinking clearly. What they are about to discover is that, in the end, they will be ordinary lemmings, just as they would have the rest of us be. They would be
under the same tight rein of government control as the rest of us. I find that thought frightening and revolting.
I believe those who feel strongly in favor of any type of government intervention in any areas not
already invaded should be very careful what they wish for. They may very well find themselves living in George Orwells "1984." Then what?
My final point is this; Live and let live. If something offends
you, but does no serious harm, get over it and move on. Let others choose, as you wish to be able to choose. Do not try to control anyone else's destiny until you have your own well in hand. (This alone should keep
their minds occupied for a very long time.) If they persist in their efforts, perhaps they could all form their own little colony, put up big walls and stay occupied telling each other what to do.

Although in my mind, there should not be anything called SPAM ....Because there is a DELETE button . Just like on TV there is a
channel selector and an OFF switch.
I am spammed around 5,000 times every day with my TV, Phone,PC, ( I have 19 E-mail boxes), & Snail Mail . But if I don't like what I'm receiving get rid of it one way
or the other.
If it is the T.V. I either change the channel or turn the cotton picker off. The snail mail ...throw it in the trash.
The phone ...(I like this one) I tell the caller I need their address so
I can send them a bill, for bothering me, they hang up immediately.
Ahhhhhhhhhh The P.C. Thank God there is a DELETE button ...do I need to say more?

Do I agree with T3, Not just Yea, but a "it's about time,Yea! If your going to make accusations, then you better be prepared to back
it up and prove it. Civilized Law states, Innocence until proven Guilty, Not the Spam law of, "be accused and you lose". As a marketer that also receives over 3000 p/day (1/3 being Spam) emails spanning 10
accounts, I have experience on both sides of the coin. Hopefully with T-3's action the global governing law bodies will move for a better balancing of Rights and Protection against those falsely accused. To often, the
supposedly accused, is in reality the victim, a victim left with little recourse under present procedures. Just my 2 cents.
Cordially,
Dr Bob

I totally agree with you, there is absolutely nothing wrong with bulk email. People have to make a living and I think it is our
responsibility to help others by not complaining when they are making a good effort to market something. After all It's better than having them rob you or steal something from you. Society needs to stop being so cynical
and self centered and should consider the needs of others as well as their own.

Thanks for the story. I side with T3 DIRECT. Why should my business be put in jeopardy by some thoughtless individual who would seem
to care less about business ethics or a solid successful, business derived from hard work and customer satisfaction. I feel for McNichol in a sense, however the fault does not lie with him or T3 DIRECT. There should be
some way of shutting down the spammer from doing e-business, unless he/she can prove the incident an isolated one and/or done by error. Regards Bob Goertzen

I support your efforts in stopping "anti-Spammers" who have accused marketers wrongly. I too, hate Spam---but 'free rides' by
those falsely accusing good businesses must end. You're working for all of us who may not have the resources to fight 'the good fight'. Best of luck to you. We'll be following the case closely. A fellow business that
ethically uses the NET! Media Blitz Consulting |

I side fully with T3 direct. I don't know exactly how much "spam" I receive each week, because I go into so many sites and
areas myself. It is not all that much more time consuming to delete unwanted messages without even looking at them. That is without any filters or sorting on the computer program. Even messages that I
know are "spam" I just immediately delete. I am sure I have signed up for different things and programs that actually were "spam" under that definition! Nikki Johnson |

I don't approve of Spam either, but it is serious when an individual (obviously a miserable old coot anyway) has nothing to do but get on
the anti-spam bandwagon. Just like other situations in life, problems need to be worked out to the betterment of everyone. Wonder what this guy does with all the postal "junk mail" he gets?
If I could sue all my postal junk mailers, I'd be rich, and I wouldn't have to try to earn a living on the net. Thank goodness you were strong in your dealings with him, and he didn't succeed in shutting you
down. Keep up the good work! Love your magazine. A subscriber. |

I'm with T3. I write a humble little newsletter for my coaching clients and prospects, and list it with two co-registration sites
which send me a few hundred subscribers per week. After I get their e-mail addresses, I subscribe them to the newsletter.Keep in mind I get only double-opt-in names from two reputable companies. These
people clicked on my newsletter, provided their e-mail address and said they wanted to subscribe. They then had to respond to an e-mail confirming they wanted to subscribe. Then, when they're finally
subscribed, it never fails, I get one or two squawking that I'm spamming them and I'd better stop. One thing I will never understand - how hard is it to press a "delete" button? We all get snail-mail
every day from people and businesses that we'd rather not hear from. Do we rant and rave by the mailbox and chase after the mailman, irate, arms flailing? No, we just throw it away without opening it. And
that stuff is actually costing the life of some trees. E-mail is the easier thing to throw away. A press of the finger and it's gone. Why this double standard? I just don't get it. And that's
ASSUMING they're getting something they didn't ask for, which in my case they never are. I have to say I get an average of 3 porn/online casino e-mails a day. Sometimes they're wily and write something like "hey,
so here's the stuff I promised" in the Subject line, and I get suckered into opening it. And you know what I do? I laugh at their ingenuity, wonder what kind of click-through rate they get with a tactic
like that, and hit the delete button. End of situation. MARIA E. ANDREU Life and Success Coach

Of course I side with the The mailer. I don't know what the big deal is about spam. The only inconvenience is checking your
email and deleting it. Some people sign up for things then think they are getting spam. They are idiots. Gloria Jean |

I agree that the anti spammers have gone from the ridiculous to the sublime. I don't like spam either and I hate it when I try to
stop mail and find that there is no way to do so, but this spam thing has gotten out of hand. You are guilty until proven innocent. That is nonsense. A friend gave me a list of people who he said were
prospects. I advertised to them and was accused of spam. Even my isp gave me a threatening letter. I wrote back to my isp and explained the situation to them and asked what happened to innocent until proven
guilty. They never answered.I think the anti-spammers need to chill a little.

I agree with T3. Anti spammers are nothing but a bunch of over educated intellectuals who have nothing better to do with their time
than complain about an imperfect world and imperfect web.I, too receive well over 1000 emails per day, most of which are junk or spam mail. But I can easily filter them and sort through them and actually read
the ones that catch my attention. Of the three email addresses that I get spam mail on, it may take me all of 30 minutes to go through the spam. It is just like junk mail from the USPS.
They (anti spammers) need to be taught a lesson. Perhaps there should be a similar law suit filed in a US court. Rodney Eccles EagleVision Publications
